Terms of Service

These Terms set out the conditions and procedures for using the AI character chat service provided by PlayOnly (the “Service”), together with the rights and obligations of the Service and its users.

The Service lets you exchange text messages with AI characters. You can create a persona representing yourself, and save facts you want a character to remember along with notes for individual conversations. During a conversation you can spend Spark to generate AI photos and short videos of the scene; they are visible only inside your own conversation.

Every character in the Service is fictional and is not a real person. Everything a character says is generated by an artificial intelligence language model and may not be true.

The Service contains adult content and may only be used by people aged 18 or over. By accessing the Service you confirm that you are at least 18. If that confirmation turns out to be false, we may restrict or terminate the account.

You are responsible for checking whether adult content is lawful in the country or region where you are located.

To use the Service you must register with an email address or sign in with a Google account. If you register by email, your account is created only after you complete the verification we send to that address.

Your account is for your own use and may not be transferred or lent to anyone else. You are responsible for keeping your password safe, and you must tell us immediately if you become aware that your account has been used without your permission.

Spark is the consumable credit used to access features such as conversations within the Service. We do not offer recurring payments or subscriptions; you buy only as much as you need, each time.

Spark cannot be exchanged for cash or any other thing of value and cannot be moved outside your account. Spark moves between users only through features the Service provides (partner shares, partner-place sales and referral rewards); users cannot send Spark to each other directly. Any Spark remaining when you delete your account is forfeited without compensation.

We may grant Spark free of charge, for example as a sign-up bonus or during a promotion. Spark granted free of charge is not refundable, and expires at the end of any period stated when it was granted.

You may cancel a Spark purchase and request a refund within 7 days of buying it. Where you have already spent the Spark you bought, the right to cancel is limited to the unspent portion, in accordance with Article 17(2) of the Korean Act on Consumer Protection in Electronic Commerce.

If a failure of the Service prevented you from using Spark you had bought, we will restore or refund the affected amount.

Please send refund requests to the contact address below. We will process them within three business days of confirming the request.

If you are a consumer in the European Economic Area or the United Kingdom, you have a statutory right to withdraw from a purchase within 14 days. By starting to spend Spark before that period ends, you ask us to begin performance immediately and accept that the right to withdraw does not apply to the Spark you have already spent.

You keep the rights to the personas, memories, notes and conversations you create. We use them only as far as necessary to provide the Service to you.

Characters in the Service are created and published by us; the Service does not offer a feature for users to create or publish characters. Photos and videos generated in your conversations are stored and used by us as far as necessary to provide the Service and operate it safely.

You must not:

• ·depict children or minors sexually, or attempt to elicit such depictions
• ·attempt to generate content that defames a real, identifiable person or depicts them sexually, using their name, details or photos
• ·attempt to generate content that plans violence or crime against others, or assists in carrying it out
• ·access the Service by automated means, or send volumes of requests that burden our servers
• ·exploit weaknesses in the Service to obtain Spark improperly or to circumvent usage limits
• ·use, or attempt to use, another person's account without permission
• ·break the law or infringe anyone else's rights

Where we confirm any of the above, we may restrict use or terminate the account without prior notice.

Everything a character sends is generated by artificial intelligence. It may be incorrect, and we do not warrant its accuracy or reliability.

Conversations with characters are not a substitute for professional advice of any kind, including medical, legal, financial and psychological advice. Where such judgement is needed, you must consult a qualified professional.

Characters are not real people and do not form real human relationships with you. The Service is provided on the basis that you understand this.

We may add, change or discontinue features. Where a significant change disadvantages users, we will give notice within the Service beforehand.

The Service may be temporarily unavailable for maintenance, during a fault, or because of events outside our control.

You may delete your account at any time from My Page. If you log back in within 30 days, your account and data are restored as they were; after 30 days they are deleted in accordance with the Privacy Policy.

We may terminate an account that has seriously breached these Terms. In that case any remaining Spark is not refunded.

We are not liable in respect of features provided free of charge, except where we have acted with intent or gross negligence.

We are not liable for decisions you make in reliance on AI-generated content, or for their consequences. Where you suffer loss caused by our intent or negligence, we remain liable as provided by law. Nothing in these Terms limits liability that cannot lawfully be limited.

These Terms are governed by the laws of the Republic of Korea. We will first try to resolve any dispute by discussion; failing that, either party may bring proceedings before the court having jurisdiction under the Korean Civil Procedure Act. If you are a consumer, this does not deprive you of the protection of mandatory rules of the country where you live.

The Korean text of these Terms is the authoritative version. Where a translation differs, the Korean text prevails.

We may change these Terms where necessary, and will publish the effective date and the substance of the change within the Service. Changes that disadvantage users are announced at least 7 days before they take effect.

If you continue to use the Service after the effective date, you are treated as having accepted the changed Terms. If you do not accept them, you may delete your account.
