Referral Program Terms

These terms set out the conditions for taking part in the referral program (the “Program”) of PlayOnly (the “Service”). Under the Program, you introduce other people to the Service and receive a reward when they buy Spark. Rewards are paid in Spark only.

Any user aged 18 or over with an account in good standing may take part. Accounts that are restricted or in the process of being terminated cannot take part.

• ·Every user has a unique referral code and referral link, which can be found in My Page › Rewards.
• ·A new user can sign up through a referral link or enter a referral code on the sign-up page.
• ·A referral code can only be entered at sign-up and cannot be added or changed afterwards.

The user who made the referral (the “referrer”) receives Spark equal to 5% of the Spark purchased by the user who signed up with their code (the “referred user”).

• ·Rewards are calculated on Spark the referred user has paid for only. Sign-up bonus Spark, event Spark and Spark received as other rewards are not included.
• ·Where the calculation results in a fraction, the reward is, as a general rule, rounded down to a whole Spark.
• ·Rewards are credited to the referrer's account automatically each time a purchase by the referred user completes.
• ·There is no cap or time limit on rewards while both the referrer's and the referred user's accounts remain active.

Spark received as a reward is treated in the same way as other Spark under the Terms of Service. It has no cash value and cannot be cashed out, moved outside the Service or transferred.

When taking part in the Program, you must not:

• ·refer yourself with your own code, including by creating multiple or second accounts
• ·generate fake or incentivised sign-ups, such as sign-ups using false information or paying people just to sign up
• ·send referral links in bulk to people who have not asked for them (spam)
• ·make untrue or misleading claims about PlayOnly's features, prices or rewards
• ·bid on PlayOnly's name, or similar search terms, in paid advertising
• ·post referral links where doing so breaks the rules of a forum, community or other site
• ·share referral links on channels or in spaces aimed at minors
• ·impersonate PlayOnly or its operator, or present yourself as an official channel

Where we find a breach of section 6 or that rewards were obtained improperly, we may:

• ·withhold the rewards concerned or reverse rewards already credited
• ·remove your eligibility for the Program
• ·restrict or terminate your account under the Terms of Service

We may also reverse rewards credited for a purchase that is later refunded or charged back.

Taking part in the Program does not create any employment, agency, partnership or joint venture relationship between you and the Service. You are not our employee or agent and cannot make promises or take on obligations on our behalf.

Spark has no cash value. However, if the law where you live imposes any reporting or tax obligations in connection with rewards, you are responsible for them.

We may change the Program, including the reward rate and the basis for rewards, or suspend or end it, and will give notice within the Service in advance.

Rewards already credited before a change, suspension or ending remain in your Spark balance and continue to be subject to the Terms of Service.

Matters not covered by these terms are governed by the Terms of Service, including governing law and dispute resolution.

If these terms conflict with the Terms of Service, the Terms of Service prevail, except for matters concerning the Program that these terms specifically address.

We may change these terms where necessary, and will publish the effective date and the substance of the change within the Service. Changes that disadvantage users are announced at least 7 days before they take effect.
